In einem anderen Thread hatte ich es schon erwähnt, doch hier findet man es leichter:

Bei uns nicht so ganz bekannt sind die US Verbraucherschutzrechte. Hier wacht mit eiserner Faust das Department of Transportation darüber. Ganz spannend ist das für US Flüge. Liegt das Ziel der Reise in den USA, dann ist dieser Flug durch das DOT geschützt. Ein Fall beim Department of Transportation ist sehr einfach einzureichen. Normalerweise reagieren Airlines bei Zurechtweisungen des Departments of Transportation sehr schnell und kundenfreundlich. Die DOT Strafzahlungen sind horrend und da wirkt meistens schon der Zeigefinger eines DOT Beamten.

Hier geht es zum Formular (runterscrollen zu File a Consumer Complaint).

Wichtig ist allerdings, dass du es schriftlich von der Airline hast, dass dir nur ein Gutschein gewährt wird. Wenn nicht, dann rufe nochmals an und drohe mit dem DOT. Zumindest brauchst du etwas Schriftliches von denen, das bei der Einreichung angefügt werden muss.

Mit geht es mit der Alaska Airlines so. Im März hätten wir zwei Inlandsflüge gehabt. Dafür bekam ich zwei Gutscheine, die bis Mitte nächsten Jahres zur Buchung einlösbar sind. Nun habe ich dafür aber gar keine Verwendung mehr und kann die Airline seit Mitte April nicht mehr erreichen. Deshalb habe ich das Formular beim DOT eingereicht.

Heute, nach genau 14 Tagen hat sich das DOT bei mir gemeldet . Hier die Antwort:

Dear Ilona,

This responds to your communication regarding Alaska Airlines. The U.S. Department of Transportation seeks to ensure that all airline passengers are treated fairly. Complaints from consumers are helpful to us in determining whether the airlines are in compliance with the law and to track trends or spot areas of concern that warrant further action.

We will forward your complaint to the airline and ask the company to respond directly to you with a copy to us. Airlines are required to acknowledge receipt of a consumer complaint within 30 days and provide a substantive response to the complainant within 60 days. We will review the airline's response. If you need to contact me, please include your name and case number (see above).

If our review of your complaint and the response from the company discloses a potential violation of the law, we may pursue enforcement action. Generally, we pursue enforcement action on the basis of a number of complaints which may indicate a pattern or practice of violating the law. Your complaint may be among those considered and may lead to appropriate enforcement action including the assessment of civil penalties. However, we have no authority to order compensation for individual complainants.

We have entered your complaint in our computerized industry monitoring system, and it will be counted among the number of complaints filed against this airline in our monthly Air Travel Consumer Report. This report allows consumers and air travel companies to compare the complaint records of individual airlines and tour operators. The data in this report also serve as a basis for rulemaking, legislation and research. Consumer information for air travelers, including the Air Travel Consumer Report and our pamphlet Fly-Rights, a Consumer's Guide to Air Travel, can be found on our website: www.transportation.gov/airconsumer.

Das ist genau die Stelle, wo ich bezweifle, dass die aus den USA eine in Deutschland ansässige Airline verklagen wollen. Nach deutschem Gesetz und nach deutschen Tarifen. Alaska Airlines ist eine amerikanische Airline, da wird das sicherlich alles machbar sein. Aber gegen die in Deutschland angemeldete Condor sieht die Rechtslage ziemlich anders aus.

Last not least bin ich mit dem Gutschein zufrieden, wenn wirklich irgendwann ein Flug daraus wird. Wenn nicht, dann sowieso nicht, dann sind die insolvent und da wird auch eine Klage nichts ausrichten. Lasst uns einfach zusammen hoffen, dass sich alles zum Guten entwickelt und dass wir unseren geliebten Urlaub in absehbarer Zeit wieder alle machen können.

Gestern habe ich nochmal meinen Taschenrechner angeworfen, weltweit hat es ca. 330.000 Tote wegen Corona gegeben. Im gleichen Zeitraum sind aber sowieso auch ca. 14 Millionen Menschen an allen möglichen anderen grässlichen Ursachen gestorben, an Krebs, an Herzinfarkt, an Hunger(!), an Infektionskrankheiten u.v.m.. Aber aus einem mir nicht bekannten Grund finden viele Menschen diese 14 Millionen Menschen "normal gestorben" und keiner Beachtung wert, aber die 330.000 Corona Toten, dafür stampfen wir großmütig unsere Wirtschaft ein. Ich verstehe es immer noch nicht.

Nachdem sich der Alaska-Airlines Kundenservice so gar nicht rührte, hatte ich die Hoffnung schon aufgegeben, doch vorgestern erhielt ich diese Mail  :adieu: :

Dear Ilona,

Thank you for your email, via the U.S. Department of Transportation, regarding your unused travel with us. It's our goal to make sure every experience with Alaska goes smoothly. The best way for us to do that is hearing from you.
Upon review of your itinerary, we noted that you went to our website to cancel your itinerary and did not contact us to inquire about a refund (until we received your U.S. Department of Transportation complaint).  Per our policy, our call center staff is consistently complying with the Department's refund guidance in that we will offer a refund when one is due.  In cases in which we significantly change or cancel a flight, a refund will be offered.  As explained above, you canceled via our website and accepted the credits at that time.

That said, your tickets did qualify for refunds and, as a result, we submitted a refund request on your behalf (in lieu of the credits you were previously offered).  That refund was paid out on June 20, 2020.  I apologize for any inconvenience you may have been caused. 

We look forward to welcoming you aboard your next Alaska flight and appreciate your patronage.


Alles Ausreden, damit sie vor dem DOT gut dastehen. Die waren zwei Wochen lang telefonisch nicht erreichbar und mein Meilenkonto löschten sie in der Zeit klammheimlich. Aber auf die paar mickrigen Meilen kommt es mir nicht an.

Jedenfalls wurden beide Tickets komplett erstattet und das Geld ist auf dem KK-Konto :happy2:.

Das ist doch super Ilona, da hat es sich gelohnt, das DOT zu kontaktieren.
